The Contaminated Sites Act (WA)

The Contaminated Sites Act (WA) - (CSA)
The Act came into force on 01 December 2006 and the main focus of this act is:
"Any person may report a known or suspected contaminated site to DEC (Department of Environment and Conservation), but under the CS Act (section 11(4)) the following persons have a duty to report such sites to DEC:
  • an owner or occupier of the site
  • a person who knows, or suspects, that he or she has caused, or contributed to, the contamination
  • a contaminated site auditor (accredited under the CS Act) engaged to provide a report that is required for the purposes of the Act, in respect of the site."

There was a six month moratorium (until 30 May 2007) on the duty to report (FORM 1) to the DEC as to "known or suspected" contamination.

GEMEC can provide expert advice on interpreting and understanding your obligations under the CSA
